These General Terms and Conditions of Sale and General Terms and Conditions of Use apply as of 03/01/2025.

2. PURPOSE
These General Terms and Conditions of Sale are intended to define the rights and obligations of "CELTISPORTGUARD" and the "Client" regarding the products offered by CELTISPORTGUARD on its website www.cynane.fr (hereinafter referred to as “the Site”).
They apply exclusively between CELTISPORTGUARD, a company registered with the Vannes Trade and Companies Register, with its registered office at 2 rue de la lande du moulin, 56890 PLESCOP, FRANCE, and any natural person (consumer) browsing or making a purchase. These terms apply to product sales made via the E-Commerce website www.cynane.fr as well as to sales conducted by phone, postal mail, or email.
The Site www.cynane.fr enables Clients to order online products from several brands (hereinafter referred to as the “Product(s)”) under these terms and conditions.
Any order placed with CELTISPORTGUARD therefore implies the Client’s unconditional acceptance of these terms and conditions. These General Terms and Conditions may be modified at any time and without prior notice by CELTISPORTGUARD, with the applicable version being the one in effect at the time of the Client’s order.
The date of the latest update is shown at the top of this document.

3. PRODUCT OFFERS
The characteristics of the Products offered for sale are available in the “Shop” section of the Site by clicking on the name or photo of the relevant Product.
Please note that minor variations (such as color or size) may exist between the product photographs and the actual product description.
The product presentation includes the essential details and characteristics of the Products, as required by Article L.111-1 of the French Consumer Code. These include:
•    the product name,
•    composition,
•    functionalities,
•    technical specifications,
•    and the price including all taxes (VAT included).

4. PRICES
The prices displayed on the Website are indicated in euros, including VAT, and excluding shipping costs. They do not include handling, shipping, transport, or delivery fees, which are charged in addition, under the conditions indicated on the website www.cynane.fr and calculated before the order is finalized.
Shipping costs apply once the customer has validated their cart and is redirected to the payment page. At this stage, the customer must provide their delivery address.
Once this step is completed, the payment requested from the customer corresponds to the total amount of the purchase, including applicable fees.
Prices are subject to change at any time without prior notice, particularly in the event of changes to tax regulations or economic conditions. Products will be invoiced based on the rates in effect at the time the order is registered.
CELTISPORTGUARD may offer promotional codes to its customers during limited-time operations. These codes can only be used directly in connection with an online order placed on the Website and may not be sold, exchanged, used for commercial purposes, or transferred for free. Promotional codes cannot be combined with each other or with any other special offer. Only one promotional code may be used per order.

5. CLIENT OBLIGATIONS
The Client declares that they are at least 18 years old and have legal capacity or possess parental authorization allowing them to place an order on the Website.
The Client agrees to provide CELTISPORTGUARD with accurate and necessary information for delivery, as requested online and according to their situation, including their full name, address, phone number, and a valid email address.
In the event of incorrect information provided by the Client, they remain solely responsible for any consequences resulting from such error. CELTISPORTGUARD cannot be held liable in such cases.

6. ORDER PROCESS
To place an order on the website www.cynane.fr, the Client must follow these steps:
•    Select the Product and desired quantity on the Site.
•    Add the Product to the cart.
•    Click on the cart icon located at the top right of the page.
•    Validate the cart. Once validated, the Client is redirected to the payment page of the cynane.fr website to proceed with their order.
•    Enter their email address, full name, and delivery address.
•    Choose a delivery method (Colissimo, Mondial Relay, or any other option available at checkout).
•    Enter the billing address.
The Client must read and accept the applicable General Terms and Conditions of Sale by ticking the checkbox stating: “By confirming my order, I acknowledge having read and accepted the General Terms and Conditions of Sale.” Confirmation of the order constitutes full acceptance of the applicable GTCS on the date of the order. The Client can save or print the GTCS.
•    Enter their bank card details.
•    Confirm the order after verifying it, by clicking the “Order and Pay” button, thereby explicitly acknowledging their obligation to pay the total amount. Before final confirmation, the Client may review the details and correct any errors.
In the event of data entry errors, the Client is responsible for any resulting delays or delivery errors and for any additional reshipping costs. After payment, the Client will receive an order confirmation email summarizing all order details and execution terms in accordance with Article L.221-13 of the French Consumer Code.
This confirmation email will include: Client contact information, delivery and billing addresses, order number and date, delivery method and timeframe, description of the ordered Product, total price including VAT, and withdrawal rights information.
CELTISPORTGUARD accepts orders subject to product availability. Availability is communicated at the time of order confirmation.
If a Product is unavailable despite CELTISPORTGUARD's efforts, the Client will be informed via email as soon as possible. The Client may cancel the order and be refunded any amounts already paid. Alternatively, CELTISPORTGUARD may offer a substitute Product of similar type, quality, and price.
Temporary or permanent unavailability of a Product shall not incur liability for CELTISPORTGUARD nor entitle the Client to compensation or damages, provided that CELTISPORTGUARD informs the Client promptly.
CELTISPORTGUARD reserves the right to cancel or refuse any order in the event of a dispute with the Client relating to a previous order.

7. DELIVERY
7.1. Delivery Areas and Methods
CELTISPORTGUARD delivers its Products within mainland France. The available delivery methods include:
•    Standard delivery (Letter rate),
•    Mondial Relay,
•    Colissimo,
•    Or any other delivery method available at checkout.
Delivery fees are automatically calculated during cart validation based on the selected shipping method, total order weight, and the delivery address provided by the Client.

7.2. Delivery Timeframes
Estimated delivery times are shown during order confirmation and depend on the chosen shipping method:
•    Standard delivery (Letter rate): approx. 3 business days after dispatch.
•    Mondial Relay: approx. 3 to 5 business days after pickup by the carrier.
•    Colissimo: approx. 2 business days after pickup by the carrier.
Order dispatch: Orders are prepared and shipped within 48 to 72 business hours after validation (excluding weekends and public holidays).
Exceptions:
During holidays, annual closures, or exceptional operational shutdowns, dispatch times may be extended. Such periods will be indicated on the website before order validation. Orders will be processed as soon as operations resume.
Legal Commitment:
In accordance with Article L.216-1 of the French Consumer Code, CELTISPORTGUARD commits to delivering Products within 30 business days of order confirmation.
Liability Limitation:
CELTISPORTGUARD is not liable for delays, losses, or damages caused by the carrier. In case of significant delay or transport-related issues, CELTISPORTGUARD will assist the Client with resolving the dispute, but the final liability lies with the carrier.

7.3. Delivery Address and Client Responsibilities
The Client must provide accurate and complete delivery information, including but not limited to: street number, building, staircase, access codes, intercom names/numbers.
In case of incorrect address or uncollected parcels:
•    Reshipping fees will be charged to the Client.
•    CELTISPORTGUARD cannot be held responsible for delays or delivery failures.

7.4. Unclaimed Parcels at Pickup Points
If the Client selects a pickup point delivery (via Mondial Relay), they agree to collect their parcel within the timeframe set by the carrier (usually 6 business days after arrival).
If unclaimed:
•    The parcel will automatically be returned to CELTISPORTGUARD.
•    This is not considered a valid withdrawal.
•    The Client may request a new shipment, subject to additional fees.

7.5. Delivery Claims and Disputes
Check Upon Receipt:
The Client must inspect the parcel upon delivery in the presence of the carrier.
In case of visible damage (open, damaged, or incomplete parcel), the Client must:
•    Make detailed remarks on the delivery slip or the carrier’s digital device.
•    Support the claim with photos or videos taken at delivery.
Notification to CELTISPORTGUARD:
The Client must inform CELTISPORTGUARD within 48 hours of receiving the parcel, including a detailed description and visual proof (photos/videos).
Liability Limitation:
CELTISPORTGUARD is not liable for damages or losses during transit but will assist the Client with resolving the dispute with the carrier.
After 3 business days without notification to either the carrier or CELTISPORTGUARD, Products will be deemed compliant, and no claim will be accepted.

7.6. Special Offers – Free Shipping
CELTISPORTGUARD may offer free shipping under certain conditions, such as a minimum purchase amount or maximum weight for certain shipping methods.
Specific thresholds for free delivery (minimum amount, weight limit, eligible carriers) are clearly indicated on www.cynane.fr at checkout.
If these thresholds change, the conditions in effect at the time of order apply.

7.7. Deliveries Outside Mainland France
Deliveries outside mainland France are only offered exceptionally, upon written agreement by CELTISPORTGUARD.
In such cases:
•    The Client is solely responsible for customs procedures and local taxes.
•    CELTISPORTGUARD is not liable for delays or issues due to these procedures.

8. PAYMENT
8.1. Payment at the Time of Order
Full payment is required at the time of order confirmation, in accordance with Article L.221-11 of the French Consumer Code.
The Client agrees to pay for the order using one of the payment methods offered by CELTISPORTGUARD and guarantees that they have the necessary authorization to use the selected payment method.

8.2. Accepted Payment Methods
Bank Card (Visa, Mastercard)
Payments are processed through the Stripe platform, which complies with international PCI-DSS (Payment Card Industry Data Security Standard) security standards.
CELTISPORTGUARD does not have access to the Client’s banking data, which is encrypted and securely transmitted directly to Stripe.
PayPal
The Client may pay via PayPal, provided they have a PayPal account. Account creation is not available via www.cynane.fr.
At checkout, the Client is redirected to PayPal’s secure platform to complete the transaction.
Klarna
Klarna allows Clients to pay using deferred or installment options, subject to Klarna’s approval.
Klarna’s terms of service are available on its official website. CELTISPORTGUARD is not responsible for Klarna’s acceptance or denial decisions.

8.3. Payment Process
After confirming the cart, the Client is redirected to a secure payment page. On this page:
•    The total order amount, including product prices and applicable delivery fees, is clearly displayed.
•    The Client selects a payment method and enters the required details:
Bank Card: Card number, expiration date, and CVV (3 digits on the back of the card).
By submitting banking information, the Client authorizes CELTISPORTGUARD to debit their account for the total amount, in accordance with Article L.133-8 of the French Monetary and Financial Code.

8.4. Payment Security and Confidentiality
CELTISPORTGUARD ensures secure and confidential transactions through compliance with strict security standards:
•    Stripe: All bank card transactions are encrypted and secured via SSL (Secure Socket Layer) protocol.
•    PayPal and Klarna: Payments made through these platforms are processed directly on their secure systems. CELTISPORTGUARD does not store any payment data. All information is handled solely by the respective secure platforms.

8.5. Retention of Ownership
According to Article 1583 of the French Civil Code, CELTISPORTGUARD retains ownership of the sold Products until full payment is received from the Client.
In case of non-payment, CELTISPORTGUARD reserves the right to suspend or cancel the order.
Retention of ownership does not affect the transfer of risk, which passes to the Client once the Products are handed over to the carrier, in accordance with Article L.216-4 of the French Consumer Code.

8.6. Payment Refusal and Order Cancellation
If payment is refused by the bank, PayPal, or Klarna, CELTISPORTGUARD reserves the right to:
•    Cancel the order and notify the Client via email;
•    Temporarily suspend the order pending valid payment.
CELTISPORTGUARD is not liable for consequences arising from a payment refusal, whether due to bank restrictions or third-party platform decisions.

9. CUSTOMER RIGHT OF WITHDRAWAL
9.1. Scope of the Right of Withdrawal
In accordance with Article L.221-18 of the French Consumer Code, any Client acting as a consumer (i.e. a natural person acting for purposes not related to their commercial, industrial, artisanal, or liberal activity) benefits from a period of fourteen (14) calendar days to exercise their right of withdrawal. This period starts from the receipt of the Products by the customer or a third party designated by them.
The Client is not required to provide any justification. However, CELTISPORTGUARD reserves the right to request, on a voluntary basis, the reason for the return for service improvement purposes.
9.2. Withdrawal Notification
To exercise their right of withdrawal, the Client must notify CELTISPORTGUARD clearly and unequivocally within 14 days of receiving the Products, via:

The Client may also use the withdrawal form available in the annex to these T&Cs (as per Article L.221-5 of the Consumer Code).
Once withdrawal is notified and validated, the Client must return the Products within 14 additional days. Products must be:
•    Unused, unworn, unwashed, in their original condition and packaging with intact tags.
•    Accompanied by the invoice or proof of purchase and the return form.
9.3. Exceptions to the Right of Withdrawal
In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal does not apply to:
•    Services fully performed before the end of the withdrawal period with the prior consent of the consumer and express waiver of their right of withdrawal.
•    Products made to the consumer's specifications or clearly personalized.
•    Products unsealed by the consumer after delivery and that cannot be returned for hygiene or health protection reasons.
•    Products likely to deteriorate or expire rapidly.
•    Products that, after delivery, are mixed inseparably with other items.
9.4. Refund
In accordance with Article L.221-24 of the Consumer Code, CELTISPORTGUARD will refund the Client for the amount paid for the returned Products, excluding initial shipping costs unless the return is due to an error by CELTISPORTGUARD (defective or non-compliant Product).
The refund will be issued within 14 calendar days from receipt of the returned Products or proof of shipment—whichever comes first.
Refunds will be made using the same payment method as the original order, unless expressly agreed otherwise.

10. PRODUCT EXCHANGES AND RETURNS
The Client has 14 days after receiving their parcel to return items that are unused, unworn, unwashed, with original labels and packaging.
To return a product, the Client must complete the return form indicating the order number and reason for return.
Only the price of the returned Products will be refunded. The Client bears the cost of return shipping.
Without a completed return form, the return cannot be processed.

Returns or exchanges are at the Client’s own risk. It is recommended to return items using a tracked and insured shipment.
The returned Product will be exchanged or refunded within 14 days after receipt by CELTISPORTGUARD, provided the Product has indeed been received.
Items must be returned complete (packaging, accessories, instructions…) and in resalable condition. Damaged, dirty, used, or incomplete items will not be refunded.

11. WARRANTY AND LIABILITY
11.1. Obligation of Means
CELTISPORTGUARD commits to taking all necessary steps to ensure site access, order processing, and product delivery, but is only bound by an obligation of means.
11.2. Legal Warranties
Products are covered by the legal warranties provided under French law:
•    Conformity Warranty: Applies to defective, damaged, or non-compliant products.
•    Hidden Defect Warranty: Applies to hidden defects that make the product unfit for normal use.
11.3. Implementation
Clients must notify CELTISPORTGUARD in writing (email or post) and return the Products in their original state. CELTISPORTGUARD may choose to repair, replace, or refund.
11.4. Exclusions
CELTISPORTGUARD is not liable for:
•    Improper use or non-compliant usage
•    Negligence or normal wear and tear
•    Damage caused by accidents, unauthorized modifications, or force majeure
•    Failure to comply with laws in the destination country
11.5. Limitation of Liability
CELTISPORTGUARD’s liability is limited to the value of the Products. It does not cover indirect or immaterial damages.
11.6. Product Compliance
Products comply with applicable European regulations and are intended for non-professional use.
11.7. Force Majeure
CELTISPORTGUARD shall not be liable in the event of force majeure (as defined in Article 1218 of the Civil Code).

12. FORCE MAJEURE
12.1. Definition and Notification
In the event of force majeure, the affected party must notify the other within 14 calendar days, with supporting documents.
12.2. Examples: Strikes, riots, wars, epidemics, natural disasters, cyberattacks, transport blockages, legal changes, etc.
12.3. Suspension
Obligations are suspended during the force majeure event without penalties.
12.4. Termination
If it lasts more than 3 consecutive months, either party may terminate the contract without compensation.
12.5. Disclaimer
CELTISPORTGUARD shall not be held responsible for any consequences resulting from a force majeure event.

13. DISPUTES AND APPLICABLE LAW
13.1. Severability
If any clause is invalidated, the rest remain in effect.
13.2. Governing Law
French law applies to all contractual relations.
13.3. Amicable Settlement
Clients should first contact CELTISPORTGUARD via email or post. If unresolved, they may use a certified mediator via https://www.economie.gouv.fr/mediation-conso
13.4. Jurisdiction
•    For consumers: local jurisdiction of the Client’s residence or delivery location.
•    For professionals: courts of Vannes, France.

Placing an order implies full acceptance of the CGV.
By confirming their order, the Client acknowledges that they:
•    Have read and understood the CGV
•    Are aware of all pre-contractual information, including product details, prices, delivery terms, and applicable rights


ANNEX I – Legal Warranty Provisions
Products sold by CELTISPORTGUARD benefit from the legal warranties provided by the French Consumer Code and Civil Code, summarized as follows:
Legal Warranty of Conformity (Articles L.217-4 to L.217-16 of the French Consumer Code)
Article L217-4: "The seller must deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. This also applies to any non-conformity resulting from the packaging, assembly instructions, or installation when these are included in the contract or carried out under the seller's responsibility."
Article L217-5: "To conform to the contract, the product must:
•    Be fit for the usual purpose of such a product and, if applicable:
o    Match the description provided by the seller and possess the qualities shown to the buyer as a sample or model.
o    Present the qualities that a buyer can reasonably expect based on public statements made by the seller, manufacturer, or their representative, particularly in advertising or labeling.
•    Or have the characteristics agreed upon by both parties or be suitable for any special use requested by the buyer and accepted by the seller."
Article L217-12: "The action resulting from the lack of conformity shall be barred after two years from the delivery of the product."
Article L217-16: "When the buyer requests repair during the commercial warranty, any immobilization period of at least seven days shall be added to the warranty duration."

Hidden Defects Warranty (Articles 1641 and 1648 of the French Civil Code)
Article 1641: "The seller is liable for hidden defects in the item sold that make it unfit for its intended use, or which diminish its usefulness so much that the buyer would not have purchased it or would have paid less for it if they had known."
Article 1648 Paragraph 1: "The action resulting from redhibitory defects must be brought by the buyer within two years from the discovery of the defect."

Client Responsibilities
To activate these warranties, the Client must:
•    Notify CELTISPORTGUARD of any discovered defect in writing (email or registered letter).
•    Return the defective products in their original condition, including all accessories, instructions, and proof of purchase.
•    CELTISPORTGUARD will cover return shipping costs if the defect or non-conformity is confirmed.
